PLEDGE OF ALLEGIANCE
PRESENTATION: Economic Development - Statement of Expectations to the belief and desire of the Cities of Nevada City and Grass Valley and the County of Nevada that the Economic Resource Council be the official economic development organization for the three governments.
HEARING FROM THE PUBLIC - BUSINESS FROM THE FLOOR
Under Government Code Section 54954.3, members of the public are entitled to address the City Council concerning any item within the Nevada City Council's subject matter jurisdiction. Comments on items NOT ON THE AGENDA are welcome at this time. Normally, public comments are limited to no more than three minutes each. Except for certain specific exceptions, the City Council is prohibited from discussing or taking action on any item not appearing on the posted agenda.

All matters listed under the Consent Calendar are to be considered routine by the City Council and will be enacted by one motion in the form listed. There will be no separate discussion of these items unless, before the City Council votes on the motion to adopt, members of the Council, City staff or the public request specific items to be removed from the Consent Calendar for separate discussion and action.

4. DEPARTMENT REQUESTED ACTION ITEMS AND UPDATE REPORTS.
City Attorney
Subject: Review a Memorandum of Understanding between the City and the Arashi Project.
Recommendation: Direction to staff.
City Manager
Subject: Update to Water System Rate Structure and Management System
Recommendation: Authorize the City Manager to negotiate a contract for engineering services to conduct an update to the water system rate structure and management system and direct staff to pursue grant funding for water system planning, engineering and improvements.
Subject: Consideration of Resolution No. 2008-XX - Approving an Agreement with Kronick, Moskovitz, Tiedemann & Girard, for Bond Counsel Services related to the Refunding. Bond Counsel Services not to exceed $10,000. Approval of a Resolution and Documentation for refinancing 3 USDA loans:
- 5% Sewer Revenue Bonds of 1982, Series A, outstanding in the principal amount of $91,000, with a final maturity date of 7/15/2022.
- 5% Sewer Revenue Bonds of 1982, Series B, outstanding in the principal amount of $318,000, with a final maturity date of 7/15/2022.
- 5% 1993 Wastewater Treatment Plant COP's outstanding in the principal amount of $620,000, with a final maturity date of 7/15/2026.
Recommendation: Approve the next Resolution in order.
PUBLIC HEARINGS
A. Appeal of the Planning Commission Approval regarding after-the-fact architectural review outside the scope of the original approval on property owned by Ruth Bleau and located at 660 Nevada Street Extension in Nevada City, CA
5. NEW BUSINESS:
Subject: Appointment of interim city councilmember to temporarily fill the position of Sheila Stein Recommendation: Direction to staff
Subject: Consideration and Discussion of request for funding not to exceed $500.00 for the State Fair Booth - Mr. Howard Levine
Recommendation: Approve request for funding the State Fair Booth
Subject: Consider Resolution No. 2008-XX, a Resolution placing on the November ballot a question of should the City Clerk and City Treasurer be an appointed position by the elected City Council
Recommendation: Approve the next Resolution in order.
Subject: Consideration and Discussion of a request for a Stonehouse Sunday Parking Lot Sale
Recommendation: Direction to Staff
Subject: Ordinance 2008-06 - Requiring the Fire Chief to Designate Very High Fire Hazard Severity Zones and Requiring the Building Official to Enforce the Requirements (first reading).
Recommendation: Direction of Staff
Subject: Possible action to retain an estate attorney to represent the city in the Estate of Charles W. Mathivet.
Recommendation: Direction of Staff
6. CORRESPONDENCE:
A. Letter from State Department of Parks and Recreation informing that the Hirschman's Trail project has been recommended for funding in the amount of $195,360.
B. Letter from William Glad thanking the City for making Nevada City such a wonderful and dynamic place to live.
7. ANNOUNCEMENTS:
A. Nevada County Celebration of Trails - May 31 to June 7, 2008
8. ADJOURNMENT

Please direct your remarks to the Councilmembers. In order that all interested parties have an opportunity to speak, please limit your comments to the specific item under discussion. All citizens will be afforded an opportunity to speak, consistent with their Constitutional rights. Time limits shall be at the Mayor's discretion. IF YOU CHALLENGE the Council's decision on any matter in court, you will be limited to raising only those issues you or someone else raised at the meeting or Public Hearing described on this agenda, or in written correspondence delivered to the City Council at, or prior to, the meeting or Public Hearing.
Request for Items on the Agenda shall be received no later than 5:00 p.m. on the Monday one week prior to the scheduled meeting, earlier if significant staff work is required for the item.
