AtPac Lawsuit Alleges Copyright Violation in 2009, But Copyright Is Dated Jan. 2010

NEVADA CITY, Calif. March 11, 2010 - AtPac, a former software provider for the Nevada County Recorder's Office, filed a lawsuit against Aptitude Solutions, the County of Nevada and the Office of the Clerk-Recorder. In their suit, AtPac alleges the defendants breached contractual obligations, infringed AtPac's copyrights and unlawfully disclosed proprietary information in 2009. However, it appears that AtPAc only filed for copyright protection in 2010.

AtPac states in their lawsuit (page 12, paragraph 62):

62. Specifically, AtPac is the owner of the right, title, and interest, in the copyright to version 3.9 of the CRiisTM software, which was duly issued by U.S. Copyright Office, Registration No. TXu1-630-807.

A search on the United States Copyright office website produces the following result:
Type of Work: Computer File
Registration Number / Date: TXu001630807 / 2010-01-26
Application Title: CRiis(TM) Version 3.9.
Title: CRiis(TM) Version 3.9.
Description: Electronic file (eService)
Copyright Claimant: AtPac, Inc.
Date of Creation: 2007
Authorship on Application: AtPac, Inc., employer for hire; Domicile: United States.
Authorship: computer program.
Rights and Permissions: Wayne Long, AtPac, Inc., 13300 New Airport Road, Auburn, CA, 95602, United States, (800) 845-7518
Names: AtPac, Inc.
The January 26, 2010 filing for software created in 2007 appears to be the only copyright application AtPac has filed with the Copyright Office. The lawsuit against Aptitude, Nevada County and the Office of the Clerk-Recorder was filed eight days later, on February 3, 2010.

According to the Copyright Office, the registration of a copyright is necessary if the holder of a copyright wishes to bring a lawsuit for copyright infringement.
