Grass Valley Planning Commissioner Rey Johnson Will Not Participate on Mine-Related Items

By: Daniel C. Holler, City Administrator

Nov. 12, 2008 - Planning Commissioner Rey Johnson has recused himself from participating in the decision-making process regarding the Idaho-Maryland Mine EIR and Development Project (Mine). The decision was reached after a review of ownership interest in property adjacent to the Mine property. It appears that a conflict of interest may be present and to avoid the perception of a conflict Commissioner Johnson will not be participating in the joint Council - Commission meeting scheduled for November 11, 2008 or in future Commission items related to the Mine.

A review of the potential conflict and action by Commissioner Johnson was also completed by the City attorney; her opinion addressed whether Commissioner Johnson had to recuse himself from the meeting and future actions. Based on the information provided and review, Commissioner Johnson has recused himself. Planning Commissioner Eleanor Kenitzer has previously recused herself from participating in Planning Commission actions regarding the Mine.
