Driving under the influence (DUI) is a very serious offense. A Nevada County judge once said that other than placing a gun in one’s hand, the next most dangerous thing one does is get behind the wheel of a vehicle while being under the influence of any substance.
Alcohol, prescription drugs, non-prescription drugs, marijuana, and a host of other substances, may place one in legal jeopardy when driving. That said, the law is very precise, and heavily litigated, and this seminar is designed for novices and professionals to enhance their knowledge of the law, the legal processes, and the penalties and costs an arrest and prosecution may have on offenders.
While the person who represents him or her may have a โfoolโ for a client, there are pieces of knowledge that can help the layman navigate the difficult shoals of a DUI prosecution. It is also important to know the weaknesses of the process, and the importance of good decision-making and honest assessments of outcomes for both the layman and the professional.
This seminar will follow the following outline: 1) the law; 2) the detention; 3) the field sobriety tests; 4) the arrest; 5) the trial and pre-trial motions and hearings; 6) the jury; 7) penalties and costs. In addition, there will be some discussion of tricks of the trade for lawyers in assisting their clients and laymen who need to understand how to help themselves.
Attendance may be in person, at the Collaborative Technology Center of the Madelyn Helling Branch of the Nevada County Library, or via Zoom from 12:00 p.m. โ 1:00 p.m. This seminar is geared towards the non-legal community, although everyone is welcome to attend. Jeff Guyton has been practicing law since 1987, having received his J.D. from the University of Virginia School of Law. He has been practicing in Nevada City for 24 years. His practice covers many areas, but he especially enjoys criminal defense. He has handled a number of DUI cases over the years, including appearing in administrative hearings on license suspensions.
